The video shows the good Senator tired and emotional, slurring his words and occasionally mumbling as he tries to attack the Republicans over their stance on health care reform.
Some reports are claiming that the video doesn’t show Max Baucus drunk, but if we accept that he hadn’t been drinking, he’d been hitting something that caused him to slur his words; given it was a health care debate, maybe some prescription drugs?

It looks like the video was pulled off of CSPAN and it is legitimate. Unless you are an expert at telling when someone is drunk by looking at a video it would be hard to tell one way or the other.
The fact that he may or may not have had a couple drinks is important though. This was important legislation and tax payers deserve their elected officials have all their faculties when dealing with such an important issue.
